Article 2 – Subject of the Agreement

This agreement sets out the parties’ rights and obligations relating to the sale, payment, delivery, withdrawal, and return of products ordered by the Buyer via the OXO Global website.

The agreement has been prepared under Law No. 6502 on the Protection of Consumers, the Distance Contracts Regulation, and other applicable legislation.

Where the relevant transaction falls within the scope of direct selling, the rights granted to the consumer by direct selling legislation are also reserved.

In purchases made for commercial or professional purposes, the applicability of consumer legislation is determined according to the legal nature of the transaction.

Article 3 – Product and Order Information

The name, essential characteristics, quantity, unit price, discounts, total price including taxes, shipping fee if any, payment method, and delivery period of the purchased products are shown to the Buyer at the time of the order.

The order summary approved by the Buyer and the Pre-Contractual Information Form are an integral part of the relevant purchase.

The order number, order date, product information, total payment amount, and delivery and billing information appear in the agreement copy created specifically for the order.

In transactions carried out within the scope of direct selling, the distributor identity and contact information required by legislation are provided to the consumer.

Article 4 – Formation of the Agreement and Payment

Before completing the order, the Buyer is informed about product characteristics, total price, delivery terms, the right of withdrawal, and the return method.

It is clearly stated immediately before payment confirmation that the order gives rise to a payment obligation.

The agreement is formed upon the Buyer’s electronic approval of the order and the agreement, completion of payment, and acceptance of the order.

A copy of the agreement and of the Pre-Contractual Information Form is transmitted to the Buyer via a durable medium.

Article 5 – Delivery

The Seller delivers the ordered products within the stated period, complete and in accordance with the promised qualities.

Subject to exceptions in legislation, the delivery period may not exceed 30 days.

Handing the product over to the courier company does not alone mean that it has been delivered to the Buyer. Until delivery, the Seller is responsible for loss and damage, subject to legal exceptions.

If the order is not delivered on time, the Buyer may terminate the agreement within the scope of their legal rights. Payments collected are refunded in the amounts and within the periods required by legislation.

If performance of the order becomes impossible, the Seller informs the Buyer within three days from the date it learns of the situation and refunds all payments collected within at most 30 days from the date of notification.

Absence of the product from stock does not alone constitute impossibility of performance.

A different product may not be sent in place of the ordered product without the Buyer’s express consent.

Article 6 – Right of Withdrawal

For products that do not fall within an exception to the right of withdrawal, the Buyer may withdraw from the agreement within 30 days from delivery of the product, without giving any reason and without paying any penalty.

OXO Global undertakes to apply this 30-day period for consumer product purchases made via its own website. Where applicable legislation grants more extensive rights, the provisions more favorable to the consumer are reserved.

Where products under a single order are delivered separately, the date of delivery of the last product is taken as the basis; for products consisting of more than one part, the date of delivery of the last part is taken as the basis.

The Buyer may also exercise the right of withdrawal before the product is delivered to them.

The withdrawal notice may be sent to the following address:

  1. 1

It is sufficient for the Buyer to clearly notify their decision to withdraw. Use of a specific form is not mandatory.

Stating the order number in the notice enables the process to be concluded more quickly. In transactions carried out through a distributor within the scope of direct selling, the distributor information required by legislation is also notified.

Article 7 – Product Returns and Refunds

After sending the withdrawal notice, the Buyer returns the product to the Seller or to the person authorized by the Seller within at most 30 days. Where the Seller offers to collect the product itself, this return shipping obligation does not apply.

Return procedures are carried out via the carrier and method stated in the Pre-Contractual Information Form.

If the Buyer uses the stated carrier, return costs are not charged to the Buyer. If no carrier is stated in the pre-contractual information, no return cost is charged to the Buyer either.

If the stated carrier has no branch at the Buyer’s location, the Seller has the product collected from the Buyer without charging any additional cost.

The Seller refunds the payments it has collected for the returned product, including standard delivery costs, within at most 30 days from the date the product is handed over to the carrier stated in the pre-contractual information.

If the Buyer uses a different carrier, the refund period starts from the date the product reaches the Seller. If the right of withdrawal is exercised before the product is delivered, the period starts from the date the withdrawal notice reaches the Seller.

Provisions that are mandatory for the relevant transaction and that grant more extensive rights in favor of the consumer are reserved.

The refund is made in a manner appropriate to the payment instrument used at the time of purchase, without imposing any additional cost on the consumer, and in a single payment.

Absence of the original invoice does not automatically eliminate the consumer’s legal rights of withdrawal or relating to defective goods. Suitable cooperation may be requested from the Buyer for return documents required by tax legislation.

Article 8 – Exceptions to the Right of Withdrawal

Where the conditions provided in legislation are met, the right of withdrawal may not be exercisable for the following products:

  • Products prepared in line with the Buyer’s special requests or personal needs.
  • Products that are liable to deteriorate quickly or that may pass their expiry date.
  • Products whose packaging has been opened after delivery or that are not suitable for return for hygiene reasons.
  • Products that, after delivery, are mixed with other products and cannot by their nature be separated.
  • Other goods and services expressly stated in legislation as falling within an exception.

The mere fact that a product is a cosmetic or personal care product does not automatically mean that there is no right of withdrawal. Exceptions are assessed according to the nature of the product and the conditions in legislation.

Exceptions to the right of withdrawal do not eliminate legal rights relating to defective goods.

Article 9 – Defective and Damaged Products

The Seller is responsible for delivery of the products in accordance with the characteristics stated in the order and with legislation.

If the Buyer detects visible damage at delivery, they may notify the courier officer and the Seller.

However, acceptance of the product or failure to draw up a courier damage report does not automatically eliminate the Buyer’s legal rights relating to defective goods.

For defective products, the consumer’s optional rights of rescission, replacement with a non-defective equivalent, price reduction, and other rights under the conditions in legislation are reserved.

Notifications relating to the product may be made to [email protected].

Article 10 – Personal Data

The Buyer’s personal data are processed for the conduct of order, payment, delivery, return, and customer service processes, in accordance with legislation on the protection of personal data.

Detailed information is available via the Privacy and KVKK Disclosure Text published on the website.

Acceptance of this agreement does not constitute consent to commercial electronic messages for marketing purposes or explicit consent.

Article 11 – Disputes

In consumer disputes arising from this agreement, application may be made to consumer arbitration committees and consumer courts under applicable legislation.

The relevant monetary thresholds and mandatory mediation provisions apply.

The parties may rely on any lawful evidence in disputes. The consumer’s legal rights of application and proof may not be limited.

Article 12 – Entry into Force

After being given the opportunity to access the Pre-Contractual Information Form presented before the order and this agreement, the Buyer completes the order electronically.

The agreement enters into force upon being concluded electronically.

The agreement and the Pre-Contractual Information Form are transmitted to the Buyer via a durable medium.

Matters not regulated in this agreement are governed by applicable legislation. The consumer’s inalienable legal rights are reserved.
